All product warranties on Brillintbed.com are offered through the product’s manufacturer. All warranty claims must be initiated directly with the product’s manufacturer. BedInABox, LLC guarantees that your mattress will be replaced or repaired at our option, should it be determined to be defective because of faulty workmanship or manufacturer's defects during the first ten (10) years of the warranty, excluding specific limitations outlined herein.

It is understood by the purchaser that this warranty does not include a normal increase in softness of the memory foam, which is normal, and does not affect the pressure-relieving quality of the mattress. This warranty covers deterioration in the cell structure of the materials that may cause the mattress to have a visible indentation greater than 1 inch during the first five (5) years of the warranty or greater than 1.25" during years 6-20, not caused by a sag in the foundation, box springs, adjustable bed, or platform. If such defects occur during the first ten (10) years of this 20 Year limited warranty we will, at our option, repair or replace the mattress. We will replace the mattress at a prorated charge to you from years 11 to 20. During the first year of the prorated 10 Year period, (year 11) the prorated replacement charge will be fifty (50) percent of the original purchase price. The prorated charge will increase by five (5) percent for each subsequent year of the prorated period.

The PacBed Original Lite mattress has a full 10 year warranty instead of a 20 year limited warranty. It is understood by the purchaser that this warranty does not include a normal increase in softness of the memory foam, which is normal, and does not affect the pressure-relieving quality of the mattress. This warranty covers deterioration in the cell structure of the materials that may cause the mattress to have a visible indentation greater than 1 inch not caused by a sag in the foundation, box springs, adjustable bed, or platform. If such defects occur during the 10 year warranty we will, at our option, repair or replace the mattress. The PacBed Original Lite warranty does not extend beyond 10 years from date of purchase.

BedInABox, LLC mattresses are designed to work on a firm, solid-surface, non-spring foundation or adjustable bed base that is structurally capable of supporting the weight of purchaser's BedInABox, LLC mattress and user(s). This warranty and other performance warranties are based on tests conducted on "sets" that consist of our mattresses and foundations/adjustable bed bases. THEREFORE, IF PURCHASER USES UNQUALIFIED FOUNDATIONS, BOX SPRINGS, ADJUSTABLE BED BASES, OR BED FRAMES WITH THIS MATTRESS, SUCH USE WILL VOID THIS WARRANTY AND ALL OTHER WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. BedInABox, LLC may require purchaser to provide proof of the quality of the foundation, adjustable bed base, platform bed, or bed frame used in conjunction with the mattress if purchaser makes a claim under this warranty. All foundations, adjustable beds, & platform beds sold on BedInABox.com will qualify as an acceptable base for your mattress. BedInABox, LLC reserves the right to invalidate this warranty if the mattress is found to be in an unsanitary condition or the foundation is found to be inadequate.

The Consumer Product Safety Commission has created the Standard for the Flammability (Open Flame) of Mattress Sets in Federal Register 16 CFR Part 1633. The foundation or adjustable bed base used with purchaser's mattress, unless specified for use as the particular foundation or adjustable bed base for the mattress purchased, should not be construed as 16 CFR Part 1633 compliant.

This warranty is valid only for the original purchaser from the original purchase date of the original mattress purchased from BedInABox, LLC. If the original purchaser sells the mattress, the subsequent purchaser takes the product "as is" and "with all faults." This warranty also does not apply to any mattress being used in a commercial setting such as hotels, motels, boarding homes, nursing homes and similar environments. Commercial settings fall under a separate warranty.

ADDITIONALLY, THIS WARRANTY DOES NOT COVER:

● A normal increase in softness of the memory foam which is normal and does not affect the pressure-relieving quality of the mattress.

● Comfort preference

● Physical abuse or damage to the structure and/or cover material, including but not limited to, burns, cuts, tears, liquid damage & stains, or abnormal soiling.

● Damage from using an improper bed frame, foundation, platform bed, or adjustable base. See above description and illustrations for a proper bed frame.

● Replacement of another piece in the BedInABox, LLC sleep system, unless other piece is also defective.

● Mattresses that are not opened and decompressed within 30 days of receipt.

In the event a warranty claim is filed and a warranty replacement is deemed necessary, purchaser will be required to surrender the original product to BedInABox, LLC at the time of replacement. All transportation/handling costs will be the responsibility of the purchaser after year five (5) of warranty, in addition to any prorated charges.

Sanya Sleep Warranty Information

Sanya Sleep takes great pride in offering our customers the absolute best customer service in the industry. At times, even the highest quality products may fail and show early signs of wear or a manufacturer defect. Sanya Sleep mattresses come with a full non-prorated warranty. Warranty begins the date you purchase the mattress and cannot be transferred. If a defect occurs during the warranty period, Sanya Sleep will repair or replace the defective product and in a reasonable amount of time.

Warranty Coverage

• Defects or deterioration in the cell structure of the latex or poly foam

• Defects resulting in splitting or cracking of the material, with normal usage and proper handling

• Body indentations:

- 1 1/2” or greater impression on an inner spring mattress

- 1” or greater impression on a quilted foam mattress

- 3/4” or greater impression on a smooth top foam mattress

• Sagging: Your mattress must be continuously supported by a foundation with solid support. This includes solid wood or metal platforms, foundations, or wire grid frames.

Not covered

• Normal increase of softness exhibited in the mattress material (breaking in process)

• Normal decrease of recovery aspects of latex (breaking in process)

• Mattress fabric (stains, normal wear & tear, etc)

• Bed height

• Sheet fit

• Body indentations: Less than minimum impressions as defined in “Warranty Coverage” above.

• Mattress damage due to an inappropriate foundation

• Mattress decompressed for extended periods of time (no more than 60 days)

Sanya Sleep mattresses have been designed to be used on a foundation with solid support that has with little or no give. This may include wood or metal foundations, box foundations, metal grid frames, or platforms. Substitution or use of improper foundations such as box springs or other bases upon which the mattress is placed is not acceptable and will void your mattress warranty and all other warranties expressed or implied. In the event of a warranty claim, you may be required to provide proof of the quality and suitability of the mattress foundation being provided to your mattress. All warranties contained herein shall not apply if the product has been physically stained, abused, damaged, burned, moisture saturated, cut or torn. Sanya Sleep reserves the right to refuse repair or replacement of any product deemed to be in an unsanitary condition. This warranty is valid only to the original purchaser of the product. If the original purchaser sells the product, the subsequent purchaser takes the product “as is” and “with all faults.” Proof of Purchase is required for all warranty claims.

Prorated Warranty

Memory Foam Mattress 10-year limited warranty:

- First three years non-prorated. We will replace or exchange the mattress if there are any manufacturer defects within the mattress during this period.

- Seven years prorated.

o Years 4-6, consumer is responsible for 40% of the cost of replacement exchange.

o Years 7-9, consumer is responsible for 50% of the cost of replacement or exchange.

o Year 10, consumer is responsible for 70% of the cost of replacement or exchange.

Gel Mattress 10-year limited warranty:

- First five years non-prorated. We will replace or exchange the mattress if there are any manufacturer defects within the mattress during this period.

- Five years prorated

o Years 6-7, consumer is responsible for 40% of the cost of replacement or exchange.

o Years 8-9, consumer is responsible for 50% of the cost of replacement or exchange.

o Year 10, consumer is responsible for 70% of the cost of replacement or exchange.

Latex Mattress:

- 10 years non-prorated. We will replace or exchange the mattress if there are any manufacturer defects within the mattress during this period.

Adjustable Bed Warranty

1 YEAR, 3 YEAR AND 25 YEAR LIMITED WARRANTY

In this warranty: “Adjustable base” means the adjustable bed foundation sold by L&P to the dealer. The “adjustable base” does not include the mattress. “L&P” means Leggett & Platt, Incorporated. “Purchaser” and “You” both mean the consumer who is the original purchaser of this adjustable base made by L&P. This warranty is not transferrable. “Warranty Commencement Date” means either (i) the date You purchased a new and unused L&P adjustable base or (ii) the date of manufacture of this adjustable base if You purchased an L&P adjustable base that has been used as floor or display model. L&P warrants this adjustable base to You on the terms and over the reducing periods of time set out below. All warranty claims require notice from You to be given to L&P in the manner set out below, and to be received by L&P inside the applicable warranty time period.

1st YEAR FULL WARRANTY

For the first year from the Warranty Commencement Date, your adjustable base is warranted against non-excluded defects in L&P’s workmanship or materials. During the first year from the Warranty Commencement Date, L&P will repair or replace (at no cost to You) any defective adjustable base part, and L&P will pay all authorized labor and transportation costs associated with the repair or replacement of any parts found to be defective.

2ND & 3RD YEAR LIMITED WARRANTY

During the second and third year from the Warranty Commencement Date, L&P will replace any adjustable base part found to be defective and not excluded by this warranty. You are responsible to pay all service and transportation costs related to the costs of receiving and installation of the new part.

4TH YEAR TO END OF 25TH YEAR LIMITED WARRANTY

Starting in the fourth year from the Warranty Commencement Date and through to the end of the 25th year from the Warranty Commencement Date, L&P will replace steel and mechanical base parts found to be defective and not excluded by this warranty. This warranty does not cover any electronics, electrical components, drive motors or massage motors. You are responsible to pay all service and transportation costs related to receiving and installation of the new part and a portion of the cost of the replacement steel and mechanical part, based on the number of months that the base has been owned by you since the fourth anniversary of the Warranty Commencement Date. By the end of the 25th year, no portion of the replacement cost is covered by L&P. You will be required to pay 1/22nd of the then current replacement cost of the part multiplied by the number of years past the third year from the Warranty Commencement Date. This portion is calculated using the following formula: Cost of the part divided by 22 [being the number of years in years 4 to 25 inclusive], multiplied by the number of years you have owned the base since the end of the first 3 years. For example, if you make a claim for a part eligible for this warranty in the 5th year since the Warranty Commencement Date, you would be responsible for paying: $100 part cost divided by 22, multiplied by 2 = $9.09.

ADDITIONAL TERMS AND CONDITIONS

This warranty requires notice to be given to L&P of any claim for repairs or replacement parts.

EXCLUSIONS

This warranty does not apply; (a) to any damage caused by You; (b) if there has been any repair or replacement of adjustable base parts by an unauthorized person; (c) if the adjustable base has been mishandled (whether in transit or by other means), subjected to physical or electrical abuse or misuse, or otherwise operated in any manner inconsistent with the operation and maintenance procedures outlined in the Owner’s Manual and this warranty; (d) to damage to mattresses, fabric, cables, electrical cords or items supplied by dealers (contact the dealer for warranty information on these items); (e) if there has been any modification of the adjustable base without prior written consent by L&P; or (f) to costs for unnecessary service calls, including costs for in-home service calls solely for the purpose of educating You about the adjustable base or finding a satisfactory power connection.

This warranty will be void if either the recommended weight restriction is not followed (refer to the advisory section of the Owner’s Manual) or if You sell or give or transfer the base to another person.

Any repairs to or replacement to Your adjustable base or its components under the terms of this limited warranty does not extend the applicable warranty from the Warranty Commencement Date. This time limitation may not apply in some jurisdictions, including the Province of Quebec.

The decision to repair or to replace defective parts under this warranty shall be made, or cause to be made, by L&P at its option and in its sole discretion.

Repair or replacement shall be the sole remedy of the Purchaser. There shall be no liability on the part of L&P for any special, indirect, incidental, or consequential damages or for any other damage, claim, or loss not expressly covered by the terms of this warranty.

This limited warranty does not include reimbursement for inconvenience, removal, installation, setup time, loss of use, shipping, or any other costs or expenses. L&P and its service technicians will not be responsible for moving furniture or any other items not attached to the adjustable base in order to perform service on the adjustable base.

It is the sole responsibility of You to provide adequate space and accessibility to the adjustable base. In the event that the technician is unable to perform service due to lack of accessibility, the service call will be billed to You and the service will have to be rescheduled.

L&P makes no other warranty whatever, express or implied, and all implied warranties of merchantability and fitness for a particular purpose are disclaimed by L&P and excluded from this agreement.

Some American States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to You.

This warranty gives You specific legal rights, and You may also have other rights, which may vary from jurisdiction to jurisdiction. This warranty is valid in all 50 American States, the District of Columbia, Puerto Rico, and all 10 Provinces and 3 Territories of Canada.

Presto Bed Frame Warranty

FASHION BED GROUP® PRESTO BED FRAME LIFETIME LIMITED WARRANTY

Fashion Bed Group® (“FBG”) warrants to the original retail purchaser (“Purchaser”) that its Presto (“Product”) will at the time of purchase be free from defects in material and workmanship caused by FBG, subject to the terms and conditions set forth herein. This warranty shall apply during the Purchaser’s lifetime.

This warranty extends only to the Purchaser and may not be assigned or transferred. A Purchaser is an individual who purchases the Product directly from an authorized retailer for the Purchaser’s own single-family residential use. If a buyer is not the Purchaser of the Product, he/she takes the Product “as is” and “with all faults.” Proof of purchase will be required to demonstrate that buyer is the Purchaser and eligible to make a valid claim under this warranty.

In the event of a breach of this warranty, upon timely notice during the warranty period, FBG’s sole obligation shall be to, at FBG’s option, either repair or replace the Product or allow credit for the Product. Repair, replacement, or a credit allowance shall be the sole and exclusive remedy under this warranty. To take advantage of this warranty, return the defective Product to the store where purchased. If the seller has moved or gone out of business, contact FBG directly for claim submission at FashionBedGroup.com and click on “Contact Us” or call 1-800-825-5233. Any transportation, shipping and handling costs, and the risk of loss during transit, shall be borne by the Purchaser. Notwithstanding the foregoing or anything to the contrary under this warranty, in the event FBG repairs, replaces, or provides a credit for the Product, FBG will have no further obligations under this warranty, and no subsequent claims will be covered.

FBG will not be responsible for repair, replacement, or credit where damage to the Product has been caused by (i) abuse, negligence, improper installation, or misuse of the Product; (ii) acts or omissions of third parties other than FBG; (iii) institutional or commercial use; or (iv) acts of God or other natural forces.

A Note on Product Care – To prevent overall soil, frequent vacuuming or light brushing to remove dust and grime is recommended. Use a professional furniture cleaning service when an overall soiled condition exists.

1. This FBG upholstered bed, headboard, footboard, or daybed is warranted to the original purchaser to be free of defects in workmanship or material for a period of one (1) year from the date of purchase from an authorized retailer. During this warranty period, FBG will, at its option, repair or replace any such defective component without charge except for transportation, shipping, and handling costs.

2. This warranty does not cover the mattress, springs, frame, or any other accessories or parts of the FBG product. Nor does the warranty cover any damage or loss related to (I) improper use, care, assembly, or service; (II) transportation, shipping, or handling; (III) institutional or commercial use; or (IV) negligence, alteration, or unauthorized repair; (V) improper cleaning; (VI) acts of God; or (VII) acts or omissions of any person or entity other than FBG. The warranty does not extend to any person other than the original retail purchaser, and may not be assigned to or transferred to another.

3. To take advantage of this warranty you must promptly (I) return the warranted component (along with the purchase receipt) for inspection to the retail seller where the FBG product was originally purchased, or (II) send written notice (along with original purchase receipt and copy of warranty) to the FBG Warranty Department. The notice must describe the product. FBG ONE-YEAR LIMITED WARRANTY UPHOLSTERED HEADBOARDS, FOOTBOARDS, OR DAYBEDS will then send written authorization to ship the component, prepaid, to the company within 90 days of such authorization. If claim is determined valid, FBG will exercise its option to either (I) repair the defective component, or (II) replace the product.

4. ANY CLAIM UNDER THIS WARRANTY MUST BE MADE BEFORE THE ORIGINAL WARRANTY PERIOD EXPIRES. Any replacement item is covered by this limited warranty until the original warranty period expires.

A Note on Product Care – The finishes on all our wood/metal beds and daybeds are designed to retain their brilliance when properly maintained. Just wipe with a clean, dry cloth. Never use cleansers, furniture polishes, or solvents as they might damage the finish.

1. The plated or painted metal and finished wood components of this FBG bed, headboard, footboard, or daybed are warranted to the original purchaser to be free of defects in workmanship or material for a period of ten (10) years from date of purchase from an authorized retailer. During this warranty period, FBG will, at its option, repair or replace any such defective component without charge except for transportation, shipping, and handling costs.

2. This warranty does not cover the mattress, springs, frame, or any other accessories or parts of the FBG product. Nor does the warranty cover any damage or loss related to (I) improper use, care, assembly, or service; (II) transportation, shipping, or handling; (III) institutional or commercial use; (IV) negligence, alteration, or unauthorized repair; (V) improper cleaning; (VI) acts of God; or (VII) acts or omissions of any person or entity other than FBG. FASHION BED GROUP® BEDDING SUPPORT ONE-YEAR Limited Warranty

FashionBedGroup.com Fashion Bed Group® (“FBG”), warrants to the original retail purchaser (“Purchaser”) that the FBG bed frame, center support system, bed rails, rollaway cot, top spring and/or pop up unit (“Product”) will at the time of purchase be free from defects in material and workmanship caused by FBG, subject to the terms and conditions set forth herein. This warranty shall apply for a period of one (1) year from date of purchase of the Product by the Purchaser from an authorized retailer.

This warranty extends only to the Purchaser and may not be assigned or transferred. A Purchaser is an individual who purchases the Product directly from an authorized retailer for the Purchaser’s own single-family residential use. If a buyer is not the Purchaser of the Product, he/she takes the Product “as is” and “with all faults.” Proof of purchase will be required to demonstrate that buyer is the Purchaser and eligible to make a valid claim under this warranty.

In the event of a breach of this warranty, upon timely notice during the warranty period, FBG’s sole obligation shall be to, at FBG’s option, either repair or replace the Product or allow credit for the Product. Sleep Tite Protector Warranties

15-Year Limited Warranty

WHAT IS COVERED

This warranty covers any defects in mattress protector materials or workmanship. It is subject to the exceptions stated below and contingent upon making a claim within five (5) days of damage and following all laundering instructions on the care label. The warranty also covers mattress stains caused by such defects if the original purchaser: (a) submits a sales receipt showing that the protector and mattress were purchased new and from an authorized retailer in the same transaction; and (b) shows that the mattress was completely covered by the mattress protector when the stain occurred.

HOW LONG COVERAGE LASTS

This warranty runs for 15 (fifteen) years from the date of purchase.

WHAT IS NOT COVERED

The warranty does not cover: (a) misuse or abuse; (b) failure to follow care instructions by (i) drying on high heat and/or without other towels or bedding (ii) using bleach or bleach detergent (iii) ironing or (iv) dry cleaning; (c) wear and tear, including rips, tears, or normal soiling; (d) stains or damage caused by or related to: (i) inks, nail polish, cosmetics, bleach, non-food related grease, corrosives, alcohol, dyes, or solvents (ii) burns or fire, natural disaster, flood, the, vandalism, or any other loss covered under an insurance policy (iii) structural problems or appliance malfunctions (iv) more than two pints of liquid; (e) mattresses not correctly fitted with the mattress protector; or (f) mattresses used for commercial, institutional, or rental purposes.

WHAT MALOUF ® WILL DO

MALOUF®, at its sole discretion will: (1) in the case of a claim for a protector, replace or refund any protector that proves to be defective in materials or workmanship; (2) in the case of a claim for mattress damage, send a cleaning kit, have the mattress professionally cleaned, replace the surface fabric, or replace the mattress.
